Creator Agreement

This Creator Agreement ("Agreement") governs the legal relationship between PT Berdikari Karya Reka, as the owner and operator of Berdikari ("We" or "Platform"), and you as a provider of content, digital products, or online services ("Creator") on the Platform.

The legal relationship between the Platform and the Creator is that of a provider of electronic commerce intermediary services (PMSE). This partnership does not create an employment, agency, franchise, or joint venture relationship between any of the parties.

The Platform applies an Automated Revenue Split system (automatic separation of amounts) to every successful sales transaction:

• Creator Wallet: The full price of the goods/services after discounts is credited to the Creator's wallet balance. For accounting purposes, the Creator's wallet balance is classified as a liability (platform payable), which means Berdikari is obligated to pay out those funds in full to the Creator.
• Berdikari Fee Pool: The platform transaction fee is automatically separated into Berdikari's asset/revenue account.
• PPN Pool: Value Added Tax (PPN) from the Buyer is withheld and held separately in a tax pool, then remitted periodically to the state treasury (DJP).

The Creator agrees to the following platform transaction fee structure and monthly/annual plan rates:

Berdikari has the right to adjust or change the transaction fee structure and subscription plan prices. However, to ensure fairness, the following mechanism must be followed:

• Berdikari will give the Creator written notice at least 30 (thirty) calendar days before the new rates take effect.
• Notice will be sent by email to the registered address and/or posted on the platform dashboard.
• The Creator must give explicit consent through the dashboard before the rate adjustment date. If the Creator does not agree, the Creator has the right to deactivate or close the account without any penalty.

The Creator can withdraw funds collected in the Creator wallet under these terms:

• The minimum amount per withdrawal (payout) is Rp 50.000.
• Payouts on the Pemula plan carry a fee of Rp 5.000 per request. Payouts are free on the Pro and Studio plans.
• Payouts are processed and transferred directly to the verified bank account registered by the Creator.

The Creator keeps the rights to uploaded work and grants Berdikari a limited permission to store, process, personalize, and deliver assets to entitled buyers.

When submitting a report, the Creator must state in good faith that they own, or are authorized to represent, the rights to the asset. A hash match, image similarity, or buyer marker is a signal for review, not an automatic legal decision.

The Creator cannot revoke buyer access directly. Berdikari administrators review the evidence, affiliate context, possible legitimate use, and buyer appeals before making a decision. Official affiliate links are permitted promotion, but distribution of protected files or resale outside the Platform can still be reviewed.

This section requires approval from legal counsel before production, including review under Law Number 28 of 2014 on Copyright and the rules on reporting copyright infringement through electronic systems.
